Shell Go+ Loyalty Programme Terms and Conditions

The following terms and conditions (the “Terms and Conditions”) govern the Shell Go+ Loyalty Programme (the “Loyalty Programme”) and the use of the Shell HK & Macau digital application (the “App”).

Please read the Terms and Conditions carefully before registering your membership by using the App.

If you do not agree to the Terms and Conditions, you will not have access to the Loyalty Programme and you are requested to refrain from accessing or using the App.

Definitions

Customer Services” means the Loyalty Programme customer services team, which can be contacted by emailing cardctr@shell.com or by calling 2435 2064 (Hong Kong)/ 6262 5067 (Macau) from Monday to Friday between 08:00 – 18:00 (except for public holidays);

Fuel” means Shell FuelSave gasoline, Shell V-Power Racing gasoline and Shell FuelSave diesel, subject to availability at Participating Sites;

Member” means a registered member of the Loyalty Programme;

Member Benefits” means discounts, coupons, vouchers, point redemption and/or special offers (made available in digital form through the App) on selected: (i) Fuel; (ii) lubricant products and services at lube bay; (iii) products at Shell Select Convenience Store; and (iv) car care services, determined by Shell at its absolute and sole discretion.

Participating Site” means a Shell service station at which the Member Benefits and Rewards of the Loyalty Programme may be redeemed. A full list of Participating Sites is available at www.shell.com.hk (please note that this list is subject to change and may be amended at Shell’s sole and absolute discretion);

Rewards” means various types of rewards that may be issued to Members and made available in digital form through the App, determined by Shell at its absolute and sole discretion;

Qualifying Purchase” means a purchase made by a Member, using the App, of either: (i) an amount of Fuel that is equal to or exceeds 1 liter at a Participating Site; or (ii) a purchase of any other product available for sale at a Participating Site excluding Fuel, tobaccos, rice, Shell promotion premiums and any other c products designated by Shell from time to time, for an amount that is equal to or exceeds HKD1/ MOP1.

Shell” means (i) for Hong Kong, Shell Hong Kong Limited, registered office at 35/F, AIA Kowloon Tower, Landmark East, 100 How Ming Street, Kwun Tong, Hong Kong; and (ii) for Macau, Shell Macau Petroleum Company Limited, registered office at Avenida da Amizade, n 876, Edificio Marina Gardens, Sala 310, 3 andar, em Macau, including their respective authorized agents who support the maintenance of the Loyalty Programme.

Third Party Scheme” means any external parties’ loyalty or customers programmes and made available for Member as Reward (please note that the schemes may change any time at Shell’s absolute and sole discretion);

Website” means www.shell.com.hk ; and

Privacy Policy” means the Loyalty Programme Privacy Policy which is available at https://www.shell.com.hk/en_hk/privacy/b2c-notice.html.

General

The Terms and Conditions are applicable to the Loyalty Programme. Any participation and use of Loyalty Programme shall be considered as acceptance of the same.

  1. Shell reserves the right to vary, add, or amend the Terms and Conditions including but not limited to usage of Loyalty Programme, reward earning, reward redemption etc. from time to time without any further notice.
  2. Shell may cancel, withdraw, alter or close registration for the Loyalty Programme at any time.
  3. Shell has the right to amend the list of Participating Sites without any prior notice.
  4. Members of Loyalty Programme must be aged 18 years or above.
  5. Members of Loyalty Programme must have a valid local mobile number, which will act as their unique identifiers.
  6. Membership of Loyalty Programme is not transferable and cannot be used by any third party other than the Member by whatever means (whether copying or otherwise).
  7. Member Benefits and Rewards are not transferable to other programs run by Shell in Hong Kong, Macau or globally, and shall be personal to the Member exclusively.
  8. Members are eligible for earning the Loyalty Programme points ("Points") with their membership accounts upon each purchase made at Participating Sites. The Points collected can be accumulated for redemption of products or services listed in the App or any designated Rewards as available for redemption from time to time.
  9. The redemption of Member Benefits and Rewards is available at Participating Sites only and is subject to availability. The Rewards are provided subject to the specific terms and conditions applicable to each Reward as set out in the App.
  10. Shell may (i) decline to open/re-open and/or (ii) remove a member from Shell Go+ accounts; and/or (iii) withdraw or cancel Member Benefits and Rewards, in whatever form, where Shell holds reasonable belief that there is/ has been:
    a. any abuse or attempted abuse of the Loyalty Programme;
    b. any breach or attempted breach of the Terms and Conditions; and/or
    c. any behaviour relating to the Loyalty Programme or any company within the Shell group of companies that involves theft, misconduct, abusive, offensive or improper behaviour, or supplying false or misleading information.
  11. Members shall notify Shell’s Customer Services immediately for any unauthorised transactions (suspicious or otherwise) in respect of their accounts.
  12. Shell reserves the right to the final decision in case of disputes.
  13. If there are any discrepancies between the English and the Chinese Terms and Conditions, the English version shall prevail.

Registration & Customer Information

  1. You can become a member of Loyalty Programme by downloading the App on your mobile devices through App Store (IOS) or Google Play (Android), and registering for Loyalty Programme.
  2. You can start using your Go+ membership once all mandatory registration details are completed in full.
  3. Your local mobile number acts as a unique identifier. Once used for registration, the same number cannot be used for the registration for another membership.
  4. You will ensure a correct mobile phone number is provided and must keep Shell informed of any changes to the information submitted. In case you would like to change your registered mobile number, you must contact Customer Service for the changes. If you register with a new number for a new membership account, Shell is not liable to transfer any previously collected Points to the new account.
  5. Shell cannot be held responsible for any loss, including any of the Member Benefits and Rewards as a result of any wrong or out-of-date information.

Loyalty Programme Benefits and Usage of Member Rewards

  1. Loyalty Programme benefits comprise of Member Benefits and Rewards and are applicable for purchase and redemption at Participating Sites.
  2. Member Benefits and Rewards are available to Members for the entire duration of their Loyalty Programme membership.
  3. Member must present his/ her in-app digital QR code or one-time password to the pump attendants or cashier of the Participating Sites before payment upon his/ her Qualifying Purchase to enjoy Member Benefits and Rewards.
  4. Shell has the right to determine, vary or change, or impose restrictions, or remove from time to time, the type, frequency or quantum of Qualifying Purchases eligible for Member Benefits and Rewards, without prior notice or assigning any reasons whatsoever.
  5. Members will receive Points from Participating Sites as per the following criteria:
    a. Fuel (Gasoline & Diesel)
    10 Points for every litre of Shell FuelSave Unleaded gasoline or Shell FuelSave Diesel purchased;
    15 Points for every litre of Shell V-Power Racing gasoline purchased (excluding purchases made under the Shell V-Power Racing Free Upgrade Offer at all stations and the Everyday Free Upgrade Offer at the designated station of the month)
    b. Helix Lubricant products
    4 Points for every HK$1/MOP$1 spending on Shell Helix Power (4 Litres), Shell Helix Protect (4 Litres), Shell Helix Ultra ECT Multi (4 Litres), Shell Helix Ultra 0W-40 (4 Litres), Shell Helix Ultra ECT C2/C3 0W-30 (4 Litres), Shell Helix Ultra Racing 10W-60 (4 Litres);
    2 Points for every HK$1/MOP$1 spending on Shell Helix Ultra 5W-40 (4 Litres);
    1 Point for every HK$1/MOP$1 spending on other Shell branded Lubricant and Labour and Parts Fee for Oil Change Service
    c. Purchase at Shell Select Convenience Store and Shell Car Care Centre
    1 Point for every HK$1/MOP$1 purchase. No Point will be awarded for purchase less than HK$1/MOP$1, of tobacco products, rice, Shell promotion premiums, and other specified goods.
  6. Any purchase which translates to a fraction of Points earned would be rounded off to the lower whole number. e.g. 41.8 litres of Shell FuelSave gasoline will yield 410 Points. Similarly, a purchase of HK$/MOP$208.90 at Shell Select Convenience Store will earn you 208 Points.
  7. Shell has the discretion to add Points to or deduct Points from Members’ Loyalty Programme account as it sees fit.
  8. Participating Sites may have seasonal offers, which will reward Members with extra Points for specific purchases. Details of these offers can be found on the App and/or the respective Participating Sites.
  9. Shell reserves the right to not issue Points in combination with other offers such as promotions or discounts, unless explicitly stated otherwise.
  10. No points will be awarded for the product, service, vouchers or coupons redeemed items purchased against redemption of points, and redemption of vouchers and coupons, unless explicitly stated otherwise.
  11. Points earned in each transaction will be credited in real time and can be checked via the App. However, in case of system delays or unforeseen circumstances, the point balance will be updated within 72 hours from the time of transaction without prior notice.
  12. Points earned as part of Loyalty Programme can be redeemed via the App and fulfilled at Participating Sites.
  13. Points redemption can only be availed by the Member.
  14. Points earned can be redeemed for vouchers for purchase at Participating Sites or for other items and services available in Loyalty Programme redemption catalogue.
  15. Loyalty Programme redemption catalogue is available on App. Members will be required to select the item, which can be availed in the Member’s next transaction at Participating Sites.
  16. Points once redeemed cannot be reversed. Items purchased against Points will not be refunded or exchanged.
  17. In case Member redeems the Points for a Shell voucher, the total value of the voucher should be automatically used in the Member’s next purchase. No cash back can be availed in case actual spend is less than the value of the voucher. Terms and conditions of the voucher applies.
  18. In case of unavailability of redeemed item at a Participating Site, Member may check for the same item at another Participating Site or may wait for that item to become available. Shell holds no responsibility to provide visibility of availability of such item at which Participating Site.
  19. For Member opting for Point conversion to a Third Party Scheme, he/she must ensure the relevant Third Party Scheme’s required membership account information is inputted correctly in the App, otherwise, Shell shall not be responsible for any loss arising therefrom, and the Points converted or Reward will not be re-issued.

Member Birth Month Offer

1. Shell GO+ members (“Member”) can get a piece of $30 Shell Convenience Store/Car Care e-voucher during first fuel transaction in their birth months, the voucher can be used in the selected products below:

  • Shell Helix Power (4 Litres), Shell Helix Protect (4 Litres), Shell Helix Ultra ECT Multi (4 Litres), Shell Helix Ultra 0W-40 (4 Litres), Shell Helix Ultra ECT C2/C3 0W-30 (4 Litres), Shell Helix Ultra Racing 10W-60 (4 Litres), Shell Helix Ultra 5W-40 (4 Litres)
  • Shell branded Lubricant and Oil Change Service Labour and Parts Fee
  • Shell Select convenience store product and Shell Car Care service.
  • The voucher is not applicable for purchases below HK$1, for tobacco products, rice, Shell promotion premiums, and other specified goods.
  • The voucher is not applicable to Airport Passenger Terminal and Airport Cargo Terminal (New) station.

2. Member must provide in advance the correct birth date (year/month/day) in the member profile in Shell GO+ App to enjoy this offer. Member’s birth date cannot be revised after submission. Member’s birth date is based on system record. Member can enjoy birth month offer once in a calendar year.

3. Member can only enjoy either birth month offer, or other Points offer, whichever is higher.

4. For enquiries, please call Shell Customer Service Hotline 2435 2064 (Hong Kong) from Monday to Friday between 08:00 - 18:00 (except for public holidays).

5. Shell Hong Kong Limited reserves the right to make the final decision in case of disputes, and the right to amend the terms and conditions hereof without prior notice.

6. If there are any discrepancies between the English and the Chinese terms and conditions, the English version shall prevail.

Fleet Solutions Customers

Members who use Shell Card as a method of payment will not be eligible for Member Benefits and Rewards of the Loyalty Programme for that transaction.

Cancelling Membership, Account Closure and Points Expiry

  1. Member may choose to leave the Loyalty Programme any time by contacting Customer Services.
  2. Member Benefits and Rewards available in his/ her account at the time of account closure will be forfeited.
  3. If an account is inactive for two years, Shell reserves the right to:
    a. reset the Points balance to zero for the account with immediate effect, and/or
    b. close the membership account with immediate effect.
  4. The validity of Points earned is two years, at the end of which they will expire.
  5. The Terms and Conditions shall remain in effect after membership account and/or access to Loyalty programme and any associated App and website is terminated.

Data Protection

As a Member of Loyalty Programme, any information shared by you is governed by the Loyalty Programme Privacy Policy. The Privacy Policy describes how Shell manages your data in accordance with the law.

Member will receive periodic updates on his/her account, promotional offer and information on the Loyalty Programme. The communication will be through the App or Member’s preferred mobile number.

Privacy Policy

  1. Loyalty Programme Privacy Policy (which forms part of the Terms and Conditions) sets out how we use Member data in relation to the Loyalty Programme. By participating in the Loyalty Programme, Member acknowledges that he/she has read, understood and accepted the Privacy Policy.
  2. For any further matters regarding the processing of Members’ personal data, please consult the Shell Privacy Policy available https://www.shell.com.hk/en_hk/privacy.html.

Security

  1. If Member chooses or is provided with a username, password or any other piece of information as part of Shell’s security procedures, Member must treat such information as confidential and he/she must not disclose it to any third party nor allow any unauthorized person access to the App under his/her username and/or password and/or any information. Member should be responsible for any actions that take place while using his/her App account or while using the App via his/her device and Shell is not responsible for any loss that results from the unauthorized use of his/her username and/or password and/or information, with or without his/her knowledge.
  2. Member shall be aware that the installation of App and use of some of its functionalities require access to the internet and your carrier's normal rates apply.

Limitation of Liability

  1. Member is responsible for the accuracy of the information that he/she enters or submits into the App. While Shell does its best to ensure that any information provided relating to the Loyalty Programme is correct at the time of inclusion, Shell cannot guarantee the accuracy of such information.
  2. Shell disclaims all warranties, express or implied, regarding your participation in the Loyalty Programme and your any associated operation and use of App and website.
  3. Member understands and agrees that his/ her participation in the Loyalty Programme and any associated operation and use of App and website is at his/her own risk, cost and consequence and that he/she is solely responsible for any damage suffered by him/her or any third party as a result of his/her participation in the Loyalty Programme and any associated operation and use of App and website.
  4. Shell shall under no circumstances whatsoever be liable to Member or any third party, whether in equity, contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with his/her participation in the Loyalty Programme and any associated operation and use of App and website for:
    a. loss of actual or anticipated profit, sales, savings, use, business, business opportunity or revenue;
    b. losses caused by business interruption;
    c. loss of goodwill or reputation;
    d. loss or corruption of data, information or software; or
    e.any indirect, special or consequential cost, expense, loss or damage suffered, even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by Member and/or Shell.

Intellectual Property Right (“IPR”)

All intellectual property contained in or on Loyalty Programme and any associated App and website is owned by Shell or its licensors. All content in the Loyalty Programme and any associated App and website including, but not limited to, text, software, scripts, code, designs, graphics, photos, sounds, music, videos, interactive features and all other content (“Content”) is a collective work under applicable copyright laws and is the proprietary property of Shell. Shell reserves all of its rights in respect of the intellectual property rights contained in the Loyalty Programme and any associated App and website and in respect of the Content.

In particular, Loyalty Programme and any associated App and website contains trademarks including, but not limited to, the mark "Shell" and the Shell emblem. All trademarks included as part of Loyalty Programme and any associated App and website are owned by Shell Brands International (“SBI”) or its licensors. Shell reserves all of its rights in respect of the trademarks included as part of Loyalty Programme and any associated App and website.

Nothing in the Terms and Conditions or otherwise shall be interpreted as granting to you any license of intellectual property rights owned by Shell, SBI or its licensors.

User Generated Content

  1. “User Generated Content” is any content such as communications, information, messages, photographs, music, videos, designs, graphics, website links, data, profiles that Members post or otherwise make available on or through Loyalty Programme and any associated App and website, except to the extent that such content is owned by or licensed to Shell.
  2. Member is solely responsible for his/her User Generated Content, interactions with other Members and in general, his/her overall activity in the Loyalty Programme and any associated App and website.
  3. Member agrees not to post any content or make any communications which may expose Shell or any of other member of Loyalty Programme and any associated App and website to harm or liability of any type.
  4. Member agrees not to post or submit User Generated Content, or a link to a website, which, is illegal, fraudulent, deceptive, misleading, libellous, infringing, harassing, hateful, threatening, abusive, pornographic, offensive in a sexual, racial, cultural or ethnic consent or is otherwise objectionable.
  5. Member confirms that he/she owns or controls all rights in any User Generated Content that he/she has posted or submitted on Loyalty Programme and any associated App and website. Member agrees not to submit User Generated Content unless he/she is the owner or has permission of the owner to post such User Generated Content. Member confirms not to post photos or videos of another person or showing another person without that person´s permission.
  6. Member’s User Generated Content is not confidential or proprietary. Member grants, and warrants that he/she has the right to grant to Shell a non-exclusive, non-revocable, worldwide, transferable, royalty-free, perpetual right to use his/her User Generated Content in any manner of media now or later developed for any purpose, commercial, advertising or otherwise, including the right to translate, display, reproduce, modify, create derivative work, sub-license, distribute, assign and commercialize without any payment due to Member.
  7. Should any part of Loyalty Programme and any associated App and website offer Member the opportunity to join in or read from a forum, please be aware that any communications posted on the forum represent the views of the individual who posted such communication and are not to be taken as the views of Shell.
  8. Member shall not use Loyalty Programme and any associated App and website or any functionality thereof for any commercial purpose.
  9. Member shall not post any User Generated Content that includes “junk mail”, “chain letters”, “pyramid schemes” or other forms of solicitation.
  10. Member shall not use automated scripts to collect information from Loyalty Programme and any associated App and website.
  11. Member shall not provide any false personal information. Member confirms not to create more than one Shell account, create a Shell account on behalf of another individual, group or entity, or transfer his/her profile or account, nor to use or try to use another person's account, username or password.
  12. Shell reserves the right to monitor any information transmitted or received through any forum provided, and, at its sole discretion and without prior notice, to review, remove or otherwise block any material posted.
  13. Shell has no obligation to pre-screen, monitor, edit or remove User Generated Content and assumes no responsibility for User Generated Content, even where it chooses to carry out pre-screening, monitoring, editing or removal of User Generated Content.

Indemnity

Member agrees to indemnify, defend and hold harmless Shell, SBI, its affiliates, officers, directors, employees, agents, licensors and suppliers from and against all claims, losses, liabilities, expenses, damages and costs, including, without limitation, legal costs arising from or relating in any way to his/her User Generated Content, his/her participation in Loyalty Programme, any associated downloading / usage of App and website or any violation of the Terms and Conditions, any law or the rights of any third party.

External Websites or Applications

Loyalty Programme and any associated App and website may include links to external websites or applications. When Members follow such links the external website or application may appear as a full screen or in some cases it may appear within the frame of App and website. These links are provided in order to help Member find relevant websites, applications, services and/or products which may be of interest to the Member quickly and easily. It is Member’s responsibility to decide whether any services and/or products available through any of these websites or applications are suitable for his/her purposes. Shell is never to be construed as recommending to Member to avail any services and/or products available through any of these websites or applications. Shell is not responsible for the owners or operators of these applications or websites or for any goods or services they supply or for the content of their websites or applications and does not give or enter into any conditions, warranties or other terms or representations in relation to any of these or accept any liability in relation to any of these (including any liability arising out of any claim that the content of any external website or application to which App and website includes a link infringes the intellectual property rights of any third party).

Severence

Each of the clauses or sub-clauses of the Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses or sub-clauses will remain in full force and effect.
